When Canadian employers wish to hire foreign workers, they must first secure an authorization from the Canadian Government. The authority is called “Labor Market Impact Assessment (LMIA)”. The Employment and Social Development Canada under the auspices of Service Canada conducts and issues such assessment. In order to receive a positive LMIA, SEDC must determine that the hiring of a foreign worker will have a positive or neutral effect on the Canadian labour market. Among other factors, it must be clear that no qualified Canadians or Permanent Residents were passed up, ignored or prejudiced in favor of foreign workers. It would also see to it that foreign workers salaries and benefits meet federal and provincial standards.
Employers must submit documentations proving that, among others, their serious attempt to find qualified Canadian citizens or permanent residents to fill up job positions before giving the pie to foreign workers.
